GENERAL INTRODUCTION:
www.prosportsuae.com (“Site”) is a website operated by Prosports Service LLC also known as Prosportsuae.We are a Limited Liability Company registered in Dubai and Sharjah, UAE.
OUR KEY PRINCIPLES:
We treat as a priority the safety and wellbeing of all children attending our Academy. We reserve the right to remove from any session any person who is found to be engaged in offensive activity, the bullying of others, disruptive behaviour or for any other reason where we consider a person’s behaviour is detrimental to the interests or safety of the persons attending a session. In the event of your removal from a Session for any of these reasons no refund of any fees paid by you shall be made.
With so many students involved in the sessions at our Academy, we acknowledge it is our responsibility to have clear safeguarding policies that are accessible to and adopted by everyone in our sports community. We are proud of our achievements in protecting young players and turning ‘best practice’ into everyday practice.
1. The child’s welfare is, and must always be, the paramount consideration. All children and young people have a right to be protected from abuse regardless of their age, gender, disability, culture, language, racial origin, religious beliefs, or sexual orientation.
2. All suspicions and allegations of abuse will be taken seriously and responded to swiftly and appropriately.
3. Working in partnership with other organisations, children and young people and their parents and carers is essential.
YOUR CONDUCT AS A PARTICIPANT:
1. It is important that the participants attend 100% of the sessions to receive the full benefit of the swim coaching program.
2. Participants are required to train at their scheduled class times in order to maintain appropriate coach to participant ratios.
3. In order for participants to achieve consistent results and progression, we recommend that all participants attend a sports program with one company only. Different approaches from different companies at the same time can have a detrimental effect on the participant’s progress.
4. The participant will be required to arrive promptly at each session (at least 5 minutes prior to the start time), with their required sports apparels such as googles, shoes, sports costume and any other equipment as directed by the coach.
5. As a participant, do not eat a heavy meal prior to the class. A light snack only is advised. No food or chewing gum is allowed around the sports ground area. It is the parent’s responsibility to supervise their child/children before and after the lesson.
6. To ensure that our coaches have the undivided attention of the participant, we request that parents refrain from talking or interacting with the child or coach throughout the session.
YOUR STATUS:
1. By booking a training session with us, you confirm that:
a. You are legally capable of entering into an agreement; or
b. You are at least 18 years old; or
c. A parent or guardian has entered into the agreement on student/participant behalf.
2. All new participants are required to attend a short assessment session prior to starting the term so that our coaches can place them in the correct level. Please note that we reserve the right to move the participant between levels during the term to ensure they are progressing at the correct level. Bring your sports kit to the assessment. Assessments are free of charge.
REGISTRATION:
1. All participants MUST complete the required form Activity Participation & Medical Release Form to be provided during registration.
2. This Participation and Medical Release form is specified for the Academy times of each session the PLAYER is registered in, and valid for the entire season.
3. All documentation will be maintained securely in our file throughout the season.
PAYMENT TERMS AND CONDITIONS:
1. All term & monthly payments must be made in advance.
2. Monthly packages are valid for 30 Days and should be renewed on time or risk losing the child’s place.
3. If you are registering once the term has already commenced, you will be required to pay for all remaining sessions in the coaching term.
4. Paid term sessions are valid only during that term and cannot be transferred to the next term.
5. All registrations/bookings are to be made via our website and are dealt with on a first come first served basis.
REFUND, CANCELLATION AND MAKE- UP POLICY:
1. We generally follow a “no refund” policy, but exceptions may be made at the discretion of the management.
2. We do not offer refunds or makeup lessons for missed sessions, except in the circumstances outlined herein. However, if we cancel a session, a makeup lesson will be offered.
3. Make up class are only allowed 1 time for monthly & termly packages and needs to be informed 24hrs in advance. communication of this should be done by completing this form: https://forms.gle/MCCBXgaWkQkF76Vf9
4. Makeup classes cannot be carried over to the following term, nor will they be reimbursed if unused.
5. We will consider makeup sessions on a case-by-case basis. In the event of an illness, please note a doctor’s note must be provided.
6. Full refunds for cancellations will only be issued under the following circumstances:
1. Major illness.
2. Major injury.
3. Hospitalization and rehabilitation exceeding two weeks.
Proof is needed in such circumstances.
HEALTH AND SAFETY:
We ask for information concerning any medical conditions with regards the person(s) wishing to train at the Academy so our staff/coaches can be made aware and in case of emergency.

PARTICIPANT’S CONSENT OF HEALTH STATUS DISCLOSURE:
I hereby confirm that [I am / my son is / my daughter is] medically fit and acknowledge that it is my responsibility to report any ailments, medications, allergies, disabilities, etc. in advance of each lesson to the Academy. I explicitly agree to assume all risks of death or injury to [my/his/her] person and/or loss of, or damage to any property of the Academy or any parent, subsidiary or affiliate company resulting directly or indirectly from [my/his/her] participation. It is my understanding and I further acknowledge that there exists the possibility of certain risks during exercise generally and particularly from this participation, including but not limited to: abnormal blood pressure, fainting, disorders of the heart, heart attack, stroke or even death. I further understand and acknowledge that there also exists the possibility of certain injuries, including but not limited to: damage to muscles, bone, organs, tendons and joints of the body. Whilst the Academy will endeavor to minimize such risks, I understand and acknowledge that in certain circumstance, such risks may still exist and notwithstanding such risks, I still consent to [my/his/her] participation. I expressly release and discharge PROSPORTS UAE and its owners, employees, agents, hired venues and assigns from any and all liabilities, claims, suits, demands or actions arising from or in connection with [my/his/her] participation in the sports programs. This release shall be binding on my heirs and executors [and those of my son/daughter]. I further agree that should [I / my son / my daughter] behave in any manner deemed by the organizers’ as disruptive or that could lead to [my / his / her] injury or that any other participant, the organizers are hereby authorized to expel [me / him / her] from any further participation in the sports coaching program without refund. Management or their hired venues will not be liable or responsible for any personal injury, accident or death, or any loss or damage to personal property or vehicles cause to or suffered by any visitors, participants, spectators or invitees attending any of the activities hosted by the Academy at any of their venues. All participants, spectators or invitees will be responsible for obtaining appropriate insurance in relation to the conducted activities.
TRANSFER OF RIGHTS AND OBLIGATIONS:
You may not transfer, assign, charge or otherwise re-assign booked sessions, or any of your rights or obligations arising under it, without the prior written consent of the Academy.
COMMUNICATION POLICY:
1. We utilize various communication methods, including email, site/sport-specific communications, and our primary social media platforms.
2. Please ensure that your contact information is kept up to date to receive all relevant communications and updates. Our goal is to provide you with information related to our clubs, events, and the latest news.
MARKETING CONSENT:
I consent to the Academy using photographs and/or video recordings including images of me and/or my children both internally and externally to promote the Academy. These images could be used in print and digital media formats including, but not limited to; print publications, websites, e-marketing, posters banners, advertising, film, social media, teaching and research purposes. I understand that images on websites can be viewed throughout the world and not just in the United Arab Emirates and that some overseas countries may not provide the same level of protection to the rights of individuals. I understand that some images or recordings may be kept permanently once they are published and be kept as an archive. I have read and understand the conditions and consent to my images being used as described. The personal data collected on this form will be held securely and will only be used for administrative purposes.
GOVERNING LAWS:
1. Any dispute or claim arising from or relating to this website will be governed and interpreted in accordance with the laws of the UAE.
2. Individuals under the age of 18 are prohibited from registering as users of this website and are not permitted to make transactions through the website.
3. If you make a payment for our products or services via our website, the details you provide will be directly transmitted to our payment provider through a secure connection. Please note that multiple transactions may result in multiple postings on the cardholder’s monthly statement. We encourage the cardholder to retain copies of any transaction records, as well as the Academy’s payment policies and Terms & Conditions.
PARTICIPANT’S DECLARATION OF RIGHTS:
I have the right to request to see a copy of the information the Academy holds about me and to request corrections or deletions
of the information that is no longer required. I can ask the Academy to stop using my images at any time, in which case it will not be used in future publications but may continue to appear in publications already in circulation.
